Birth Pool & Elle TENS Hire Terms & Conditions

By placing a booking with NOURISHER for a Birth Pool or Elle TENS device, you confirm that you have read, understood, and agreed to the following terms and conditions.

1. Hire Equipment Overview

Nourisher hire kits are designed to support comfort, preparation, and natural pain management during labour and birth.

  • Birth Pools: Intended for home use to enhance comfort during labour. Pools are not medical devices and do not replace care from a qualified healthcare professional.

  • Elle TENS: The Transcutaneous Electrical Nerve Stimulation (TENS) device is a non-invasive, drug-free tool for pain management. Effectiveness may vary, and labour outcomes cannot be guaranteed.

All equipment is provided for personal use only by the individual named in the hire form.

2. Eligibility & Responsibility

By booking, you confirm:

  • You are 18 years or older

  • You have discussed and sought approval from your midwife or healthcare provider regarding water birth or TENS use

  • You accept full responsibility for safe use and setup of the equipment

Nourisher is not liable for any medical outcomes, injuries, or property damage arising from the use of the hire items.

3. Hire Period

  • Standard hire duration: 7 weeks, starting from 36 weeks gestation to allow preparation for birth

  • It is recommended to book at least 4 weeks before your expected due date

  • Early returns do not qualify for part refunds

  • Late returns will incur a $10 per day fee beyond the agreed hire period

4. Replacement costs

  • TENS device: $205

  • Electrodes: $70 (if supplied)

  • Cables: $20

  • Pouch / container: $10

  • Instruction booklet: $5

  • Lanyard: $5

  • Tac Gel (if supplied): $5

  • Birth Pool $379

  • Liner $80

  • Pump $120

  • Hose $50

  • Hose and tap attachments $40 each

  • Pool box $40

  • Pumps $50 each

  • For Birth Pools, cleaning fees of up to $200 may apply if items are returned unsanitary or damaged.

5. Delivery & Returns

  • Elle TENS: Door-to-door overnight delivery available New Zealand-wide; prepaid return postage included

  • Birth Pool: Must be collected and returned to Silverdale, Auckland

  • All equipment must be returned clean, dry, and securely packed in the original packaging or protective bag

  • Failure to return equipment or returning it damaged may result in full replacement charges

  • Customers are responsible for tracking equipment if delays occur during postal transit

6. Proper Use & Safety

Birth Pool:

  • Use indoors on a stable, level surface

  • Never leave filled pools unattended

  • Avoid overfilling or overheating

  • Keep sharp objects, pets, heaters, and other hazards away

  • Follow all setup and cleaning instructions

Elle TENS:

  • Only for use by the person named in the hire form

  • Follow all instructions in the Elle TENS user guide

  • Ensure batteries and leads are correctly fitted

  • Do not use if advised against by your healthcare provider

Nourisher is not liable for injury, misuse, or property damage.

7. Cancellations & Refunds

  • Birth Pool:

    • Cancellations made more than 14 days before the hire start date are eligible for a refund, minus a $50 admin fee

    • Cancellations within 14 days of the hire start date are non-refundable

  • Elle TENS:

    • Cancellations more than 14 days before booking: refund minus a $15 admin fee

    • Cancellations less than 14 prior to booking: non-refundable

  • No refund is given if equipment is unused, unclaimed, or returned early

8. Equipment Checks

  • Please check the contents of your hire pack upon receipt

  • Notify Nourisher immediately if any items are missing, damaged, or faulty

  • Equipment is tested before dispatch; liability is limited to the hire fee paid

9. Liability & Disclaimer

Use of all hire items is at your own risk.

  • Nourisher is not responsible for injury, loss, or property damage arising from misuse

  • Liability is limited to the total hire fee paid, to the extent permitted by New Zealand law

10. Privacy

Your personal information is used solely to manage your hire booking and is handled in accordance with Nourisher’s Privacy Policy.

11. Governing Law

These Terms & Conditions are governed by the laws of New Zealand.

12. Changes to Terms

Nourisher reserves the right to update these terms at any time. Material changes will be notified at least 30 days in advance, where possible. Continued use of the service after changes constitutes acceptance of the new terms.
